In light of the difficult security situation in Lebanon, particularly with the growing number of displaced persons who represent one of the most vulnerable groups in the current circumstances, many individuals have expressed a willingness to temporarily host displaced persons they know in vacant apartments they own.

However, a significant number of property owners remain hesitant to do so due to concerns arising from Lebanon’s legal environment and past negative experiences with tenancy legislation, particularly following the legislative extensions imposed on old lease agreements. These concerns often relate to the fear that allowing someone to occupy a property, even on a purely humanitarian basis and free of charge, could later create legal complications or make it difficult for the owner to recover possession of the property.

In response to these concerns, we have prepared a “Tolerance Agreement” for several of our clients, designed to provide the maximum possible level of legal protection for property owners while enabling them to offer temporary accommodation. In the spirit of encouraging solidarity and responsible use of vacant properties during this challenging period, we have decided to make this template available to the public. The model agreement includes a number of protective clauses that landlords may adapt according to their needs, allowing them to determine which provisions to maintain, modify, or remove depending on the specific circumstances of each situation.

نظراً للأوضاع الأمنية الصعبة التي يشهدها لبنان، ولا سيما في ظل تزايد أعداد النازحين الذين يُعدّون من الفئات الأكثر ضعفاً في هذه الظروف، أبدى العديد من الأشخاص استعدادهم لاستقبال نازحين يعرفونهم في شقق يملكونها وتكون شاغرة لديهم. إلا أن عدداً كبيراً من مالكي العقارات ما زالوا يترددون في القيام بهذه الخطوة، نتيجة المخاوف المرتبطة بالوضع القانوني في لبنان والتجارب السلبية السابقة مع التشريعات الإيجارية، ولا سيما بعد قيام المشترع بتمديد العمل بقوانين الإيجارات القديمة. وغالباً ما تتمحور هذه المخاوف حول احتمال أن يؤدي السماح لأي شخص بالإشغال، حتى ولو كان ذلك على سبيل التسامح أو بدافع إنساني ومن دون أي بدل، إلى نشوء تعقيدات قانونية لاحقة أو إلى صعوبة استرداد المأجور.

وانطلاقاً من هذه الهواجس، قمنا بإعداد نموذج «عقد إشغال على سبيل التسامح» لبعض عملائنا، بحيث يهدف هذا النموذج إلى تأمين أكبر قدر ممكن من الحماية القانونية لمالك العقار، مع تمكينه في الوقت عينه من تقديم مساعدة مؤقتة عند الحاجة. وبهدف تشجيع روح التضامن والاستفادة من الشقق الشاغرة خلال هذه المرحلة الدقيقة، ارتأينا نشر هذا النموذج وإتاحته للعموم. ويتضمن هذا النموذج مجموعة من البنود الحمائية التي يمكن للمالك تعديلها أو الإبقاء عليها أو حذفها بحسب ما يراه مناسباً، وبما يتلاءم مع ظروف كل حالة على حدة.
